Buying Land in Bacalar: A Foreign Investor's Guide

Lagoon-front or one block back, trust or company, and the federal strip along the shore: what a foreign investor should settle before buying land on the Bacalar lagoon.

Destinations8 min readUpdated October 2026

To buy land in Bacalar is to take a position on a lagoon that is still defining its rules. The infrastructure has arrived, the planning instruments are being written, and the environmental questions are openly debated. That combination rewards a buyer who does the legal and environmental work first. This guide covers the restricted-zone structure, the federal shoreline strip, the environmental framework around the lagoon, price per square metre on real listings, and a due-diligence checklist. For the full purchase process, read our guide to buying property in Mexico as a foreigner.

Why Bacalar now

Three developments shape the moment.

  • Rail access. The Maya Train's Bacalar station has been in service since late 2024, linking the town with Chetumal, Cancún, Playa del Carmen and Mérida. Early reporting is candid: in July 2025, local operators described almost no measurable rise in visitors arriving by train. The infrastructure is in place; the demand effect is still to be proven. Our Maya Train guide follows the evidence.
  • Planning in progress. In December 2025 the federal and municipal governments announced the agreement to formulate a local ecological zoning program (POEL) for Bacalar, which will assign land uses and environmental management units across the municipality.
  • Protection debate. Proposals for a federal protected area covering the Bacalar–Chetumal lagoon system have been revived and contested; as of September 2025, business groups and ejidos were opposing a declaration, and none had been issued.

The case for acting now is one of positioning: titled, well-documented land, bought with clear knowledge of the rules that apply today and the rules that may follow. Speculation has been here before. In 2019, a local engineers' association described a jump in Bacalar land from MX$1,000 to MX$4,500 per m² as "pure speculation". Discipline matters more than timing.

Lagoon-front vs one block back

Two Ownext listings illustrate the choice.

Bacalar para Visionarios is a 6,000 m² titled lot with 60 m of lagoon frontage and 100 m of depth. It is registered in the public property registry, carries no liens, its property tax is current, and it is reported under UGA T7 environmental zoning. The asking price is MX$42,000,000.

Lotes Laguna Bacalar MZ50, at Calle 30 and Blvd. Costero, comprises 16 residential lots of 969–1,071 m², one block from the lagoon. Each lot has its own deed and property-tax account. A hotel lot is adjacent, a beach club sits across the boulevard, and neighbouring lots have sold. The price is MX$750,000 per lot, roughly MX$700–775 per m² (approximate). At Bacalar's 2% ISAI, the transfer tax on one lot is MX$15,000 (MX$750,000 × 2%).

The trade-off

  • Lagoon-front offers the scarce asset: direct water frontage. It also carries the shoreline obligations described below: the federal strip, environmental review for works at the water, and greater scrutiny.
  • One block back does not touch the shore, so the shoreline strip does not cross the lot itself. Municipal and environmental rules still apply, and the lot sizes suit a private residence or a small, phased project at a far lower entry ticket.

Restricted zone and fideicomiso in Bacalar

Bacalar lies a short distance north of Chetumal and the Belize border, inside Mexico's restricted zone: 100 km from the borders and 50 km from the coast (Constitution, Art. 27, fr. I). Foreigners cannot hold direct title there. Two routes are available.

  • Bank trust (fideicomiso) for residential use. A Mexican bank holds title for you under a permit from the Secretaría de Relaciones Exteriores (Foreign Investment Law, Art. 11). The term is up to 50 years and can be extended (Art. 13). The 2026 permit fee is MX$21,650.
  • Mexican company for non-residential use, such as a boutique hotel. A company that admits foreign shareholders may own the land directly and must notify the SRE within 60 business days (Art. 10). The 2026 notice fee is MX$1,475.

The choice should follow the use you intend, not the other way round. Our fideicomiso guide compares the two in detail.

Federal zone and environmental limits on the lagoon shore

The shoreline of a lagoon is not simply the end of a private lot. Federal law reserves a strip along it, and which rule applies depends on how the authorities classify the water body.

The federal strip

  • Inland national waters: the National Waters Law defines a federal zone of 10 m alongside the vessel of national water bodies, measured horizontally from the ordinary maximum water level (5 m for channels no wider than 5 m) (LAN, Art. 3).
  • Lagoons connected to the sea: for lakes, lagoons and estuaries that connect directly or indirectly with the sea, the General Law of National Assets sets a 20 m federal maritime-terrestrial zone (ZOFEMAT), measured from the highest annual water level; SEMARNAT carries out the delimitation (LGBN, Art. 119).

Do not assume which regime applies to a given stretch of Bacalar's shore. Ask for the official delimitation that covers the lot, and have the surveyor plot it against the deed boundaries before you price the usable area.

Environmental review

  • Works in wetlands, coastal ecosystems and lagoons connected with the sea, and in their federal zones, require federal environmental impact authorisation (LGEEPA, Art. 28, fr. X).
  • Removing, filling or pruning mangrove, or any work that affects its water flow, is prohibited except for conservation and restoration (Wildlife Law, Art. 60 Ter).

Protection status

A small area in the town, known as Parque Laguna de Bacalar, was decreed a state ecological park in 2011; within it, only conservation, research, recreation, ecotourism and similar uses are permitted. A wider federal protected area has been proposed but not declared. Separately, the lagoon region is subject to ecological zoning by environmental management units (UGAs); press coverage of past projects cites the ecological zoning program for the Laguna de Bacalar region. The new municipal POEL may revise this framework.

Price per m²: what the listings show

Verified, current market-wide price data for Bacalar is limited, so the figures below are Ownext's asking prices, not market averages.

ListingSizeAsking pricePrice per m²
Bacalar para Visionarios (lagoon-front)6,000 m²MX$42,000,000MX$7,000
Lotes Laguna Bacalar MZ50 (one block back)969–1,071 m²MX$750,000 per lot≈ MX$700–775
Reserva Carretera Federal (Bacalar, between the Federal Highway and the lagoon)10 lots of 10,000 m² (1 ha)MX$5,000,000 per lot (MX$50,000,000 for all ten)MX$500

Lagoon frontage commands roughly a ninefold to tenfold premium per m² over a lot one block back: MX$7,000 against about MX$700–775/m² (MX$750,000 per lot). Measured another way, the lagoon-front lot costs MX$700,000 per linear metre of frontage. The Reserva Carretera Federal is a different instrument altogether: titled land in Bacalar between the Federal Highway and the lagoon, with 350 m of highway frontage, divided into ten 1-ha lots at MX$5,000,000 each that can be bought individually or together and deeded to the buyer.

Due diligence checklist before you buy land in Bacalar

  1. Private title, not ejido. Confirm a deed (escritura) registered in the public property registry. Ejido parcels become private only after an assembly resolution and cancellation at the National Agrarian Registry (Agrarian Law, Arts. 81–82). In June 2026, nearly 200 families in Bacalar were reported to have bought ejido lots sold without that authorisation. See ejido vs titled land.
  2. Lien certificate. A current certificado de libertad de gravamen from the registry.
  3. Taxes and services. Property tax (predial) and water paid to date.
  4. Survey. A topographic survey matching the deed's measurements and boundaries, with the federal-zone line plotted.
  5. Zoning. The municipal land-use certificate and the UGA criteria for the lot.
  6. Environment. Presence of mangrove or wetland, and the permit path for what you intend to build.
  7. Access and utilities. Legal road access, power, water and wastewater solution.
  8. Structure. Trust or company, decided before the deed is drafted.
  9. Costs. ISAI at 2% in Bacalar (municipal Ley de Hacienda, Art. 57) of the highest of price, cadastral value or appraisal, plus fees; see closing costs in Quintana Roo.
  10. Counsel. A notario público for the deed and an independent lawyer working for you.

Questions investors ask

Can a foreigner buy land in Bacalar?

Yes, but Bacalar is in the restricted zone, so a foreigner holds residential land through a bank trust (fideicomiso) with an SRE permit. A Mexican company that admits foreign shareholders can own land directly for non-residential use and must notify the SRE within 60 business days.

Can I build right up to the edge of the Bacalar lagoon?

No. Federal law reserves a strip along the shore: 10 m for inland national waters, or 20 m for lagoons connected with the sea. Request the official delimitation for the lot, and expect federal environmental review for works in the lagoon or its federal zone.

Is the Bacalar lagoon a protected area?

A small area in the town has been a state ecological park since 2011. A wider federal protected area has been proposed and contested but, as of the latest reporting we found (September 2025), not declared. Ecological zoning by UGA applies, and a new municipal program is being prepared.

How much does land cost per m² in Bacalar?

Reliable market-wide data is limited. On Ownext's current listings, lagoon-front land is offered at MX$7,000 per m² and lots one block back at MX$750,000 per lot, about MX$700–775 per m².

How do I avoid buying ejido land by mistake?

Insist on a deed registered in the public property registry and a current lien certificate. If the land was once ejido, confirm the assembly resolution and its cancellation at the National Agrarian Registry before paying anything.
